UTILITY EASEMENT CONSTRUCTION

What is going on?

As many of our homeowners have already discovered, Frontier Communications has contracted with Mid Ohio Pipeline to install conduits in utility easements throughout the Scioto Reserve community. The conduits will allow for the installation of new fiberoptic cable that will potentially provide a new and alternative internet service to residents. The installations you are seeing throughout the community are not being performed with the HOA’s approval or oversight. Mid Ohio Pipeline and Frontier Communications are private companies legally operating within existing utility easements on private property. While these companies have the right to access the existing easements on home lots and community open spaces, they are legally required to return the property to its original condition upon completion of their work.

When will my yard get fixed?

While the contractor performing the work is responsible for returning any disturbed ground to its original condition, there is not an established timeframe for when the repairs must be completed. Given the current season and the nature of the need restoration, it is only reasonable to assume much of the repair work will be completed during the growing season.

Do I have a utility easement on my property?

Many of the home lots and open spaces throughout the community have a drainage and/or utility easement located on them. The presence and location of any easements can be confirmed by reviewing the plot plan or survey you received when you purchased your home. If you cannot find your plot plan, you can review the plat for your section on the Delaware County Auditors website using the links below. If you are unsure which section you lot is located, you can perform a search of your address on the auditors GIS site at https://auditor.delco-gis.org/

What do I need to do and who can I talk to?

We are advising all owners who have had work done on their property to photograph and document any and all damage to their yards and/or landscape.
